Terms & Conditions / Guest Accommodation Contract

The following conditions, based on the recommendations of the German Tourism Association (DTV), become part of the guest accommodation contract concluded between the guest and the host upon booking. They regulate the contractual relationship between the guest and the host in addition to the statutory regulations.
(Note: In case of discrepancies between the German and English versions, the German version shall prevail.)

1. Conclusion of the Guest Accommodation Contract
  1. With the booking, the guest offers the host the conclusion of the guest accommodation contract in a binding manner.
  2. The booking can be made via all booking channels offered by the host (written, oral, by telephone, electronic).
  3. The guest accommodation contract is only concluded upon receipt of the declaration of acceptance (booking confirmation) from the host. For electronic bookings, this confirmation is sent immediately.
  4. The booking is made by the booking guest also for all persons listed in the booking, for whose contractual obligations the booking guest is liable as for their own obligations.
2. Services and Prices
  1. The services owed by the host result exclusively from the booking offer in connection with the booking confirmation.
  2. The prices quoted are final prices. They include all utility costs for the vacation rental.
3. Payment
  1. No down payment is required.
  2. The total rental price is due on the day of arrival. Payment is to be made in cash unless otherwise agreed.
4. Arrival and Departure
  1. The host will make the rental property available to the guest in the contractually agreed condition from 3:00 PM to 6:00 PM on the day of arrival.
  2. The guest must vacate the rental property and hand it over in a swept-clean condition by 10:00 AM on the day of departure.
5. Duties of the Guest & House Rules
  1. The guest must treat the rental premises, the furnishings, and the inventory with care.
  2. The guest is liable for damages culpably caused to furnishings, rental rooms, or the building within the framework of the statutory regulations.
  3. The guest undertakes not to throw waste, ashes, harmful liquids, or similar items into sinks, drains, or toilets. In the event of non-compliance, the person responsible is liable for the costs of repair.
  4. No Smoking Policy: Smoking is strictly prohibited throughout the entire vacation rental. Smoking is permitted exclusively in the outdoor area (e.g., terrace or in front of the house).
6. Withdrawal by the Guest (Cancellation)
  1. The guest cannot unilaterally withdraw from a legally binding booking free of charge.
  2. If the guest nevertheless withdraws from the contract before the start of the rental period, they are obliged to pay the agreed accommodation price minus saved expenses.
  3. In the event of withdrawal, the guest must pay flat-rate compensation according to the following scale:
    • Cancellation up to 45 days before the start of the rental period: 20% of the travel price
    • Cancellation up to 35 days before the start of the rental period: 50% of the travel price
    • Thereafter and in case of no-show: 90% of the travel price
  4. The guest remains free to prove that the host has incurred no or significantly lower damage.
  5. The withdrawal must be made in writing. The decisive factor is the time of receipt of the declaration by the host.
  6. We strongly recommend taking out travel cancellation insurance.
7. Termination Rights

There is no right to ordinary termination. However, both contracting parties are entitled to terminate the rental contract without notice and for good cause in accordance with § 543 BGB (German Civil Code) or § 569 BGB.

8. Defects and Liability
  1. The host is liable for the proper performance of the contractually agreed service.
  2. If the vacation rental has a defect, the guest must report this immediately. If they culpably fail to do so, they are not entitled to any claims.
  3. The host’s liability for damages that are not bodily injuries is limited to three times the price of the agreed service (except in cases of intent/gross negligence).
  4. The host is liable for brought-in items in accordance with statutory provisions (§ 701 et seq. BGB).
9. Wi-Fi Usage
  1. The guest is solely responsible for the data transmitted via the Wi-Fi.
  2. The guest undertakes to comply with applicable law when using the Wi-Fi (no illegal downloads/file sharing).
  3. The guest indemnifies the host against all damages and claims by third parties based on unlawful use of the Wi-Fi by the guest.
10. Pets

Animals, especially dogs, may only be brought along with the express prior permission of the host. The guest is liable for all damages caused by keeping animals.

11. Choice of Law and Place of Jurisdiction

German law applies. The place of jurisdiction is exclusively the registered office of the accommodation establishment, to the extent permitted by law.
